1. Your Contract With Us
A binding contract comes into existence once we issue written confirmation of your booking following receipt of your required deposit. The contract is between you (and any additional travellers named on the booking) and Trevaron Travel & Tours, a locally registered Kenyan safari company.
If you book on behalf of other travellers, you confirm that you are authorised to do so, that all information you provide on their behalf is accurate, and that you accept responsibility for ensuring they are aware of and agree to these Terms. If any traveller on the booking is a minor, the responsible adult booking on their behalf warrants that they are legally entitled to do so and that the minor will be accompanied throughout the journey by a responsible adult.
2.Itineraries & Pricing
Every itinerary we provide is a proposed starting point, built around your preferences and refined in consultation with you before booking. Prices quoted are based on costs and exchange rates current at the time of quotation and remain valid for the period stated on your quote. Prices are subject to change before a deposit is received, due to factors including but not limited to exchange rate fluctuation, fuel costs, accommodation rate changes, and government taxes or levies.
Once your deposit has been received and your booking confirmed, prices are guaranteed except in cases of a documented increase in government taxes, park or conservancy fees, or significant currency fluctuation beyond our reasonable control, in which case we reserve the right to apply a surcharge. Where a surcharge is necessary, we will notify you in writing.
3. Deposits & Payment
To confirm a booking, a deposit of 30% of the total safari cost is required at the time of booking. The balance of the total cost is due no later than 45 days prior to your departure date.
For bookings made within 45 days of departure, full payment is required at the time of booking.
Certain properties and experiences, including but not limited to peak-season accommodation, gorilla trekking permits, hot-air balloon safaris, and exclusive-use camps, may require full prepayment or a higher deposit due to the advance commitments we must make on your behalf. Where this applies, we will inform you clearly before you confirm your booking.
Failure to pay the balance by the due date may result in cancellation of your booking, with cancellation charges applied as set out in Section 4 below.
4. Cancellations & Refunds
All cancellations must be submitted to us in writing. The effective date of cancellation is the date we receive your written notice, not the date you decide to cancel.
Because we commit funds to camps, conservancies, airlines, and other suppliers well in advance on your behalf, cancellations are subject to the following tiered schedule, calculated from the date of written notice to your scheduled departure date:

Where a specific supplier, such as a gorilla trekking permit issuer, a private conservancy, or an exclusive-use camp, applies a stricter cancellation policy than the schedule above, the stricter policy will apply to that portion of your booking, and we will inform you of this at the time of booking.
If we are required to cancel your safari due to circumstances within our control, you will be offered a full refund or the option to transfer your payment to an alternative date. If we cancel due to circumstances beyond our reasonable control (see Section 9, Force Majeure), refunds will be issued less any costs already incurred on your behalf that we are unable to recover from our suppliers.
We are not responsible for any incidental costs you may incur as a result of a cancellation, including but not limited to international flights, visa fees, vaccinations, or travel insurance premiums. For this reason, we strongly recommend comprehensive travel insurance that includes cancellation cover (see Section 8).
5. Changes to Your Booking
We will always do our best to accommodate changes you request after booking. Minor adjustments, such as a change to a dinner reservation or an optional activity, are generally accommodated without charge, subject to availability.
Significant changes, including changes to travel dates, destinations, accommodation, or the number of travellers, may incur an administrative fee in addition to any costs passed on by our suppliers. We will confirm any applicable fee with you before processing the change. A change requested within 60 days of departure may, depending on the nature of the request, be treated as a cancellation and rebooking, with the cancellation charges in Section 4 applying accordingly.
6. What’s Included & What’s Not
Each itinerary we send you includes a clear, itemised list of inclusions and exclusions specific to that trip. As a general guide, our safaris typically include private vehicle transport with a dedicated driver guide, accommodation on the meal plan specified, game drives and activities as outlined in your itinerary, and relevant park or conservancy fees.
Unless explicitly stated otherwise in your itinerary, the following are not included: international flights, visa and entry authorisation fees, travel insurance, vaccinations, gratuities, items of a personal nature, and any activities not specifically named in your confirmed itinerary.
7. Travel Documentation
It is your responsibility to ensure that you, and every traveller on your booking, hold a valid passport (with the minimum validity required by your destination countries), any required visas or electronic travel authorisations, and any vaccination certificates required for entry. Requirements vary by nationality and by itinerary, and they do change from time to time. While we are glad to provide general guidance, we strongly recommend confirming current requirements directly with the relevant embassy, consulate, or official government portal before booking flights.
Trevaron is not liable for any cost, loss, or denial of entry arising from a traveller’s failure to hold the correct or valid travel documentation.
8. Travel Insurance
Comprehensive travel insurance is mandatory for all travellers on a Trevaron safari. At a minimum, your policy must provide cover for emergency medical expenses, emergency evacuation and repatriation, and personal accident. We strongly recommend that your policy also covers trip cancellation and curtailment, given the cancellation terms set out in Section 4.
You must hold valid travel insurance for the full duration of your trip and be able to provide evidence of this on request. Trevaron does not provide travel insurance and is not responsible for any loss arising from inadequate or absent cover.
9.Force Majeure
Trevaron Tours and Safaris will not be held liable for any failure to perform, or delay in performing, our obligations under these Terms where that failure or delay arises from circumstances beyond our reasonable control. This includes, without limitation, natural disasters, severe weather, fire, epidemic or pandemic, war, civil unrest, terrorism, government action, strikes, and airline or airport disruption.
Where such circumstances affect your booking, we will work with you in good faith to explore alternatives, including rescheduling, but we are not obligated to provide a refund beyond amounts we are able to recover from our suppliers.
10. Your Conduct & Safety on Safari
Safari travel involves inherent risks associated with wildlife, remote environments, and activities including game drives, walking safaris, and water-based excursions. You participate in all such activities entirely at your own risk, and you are responsible for assessing your own fitness and suitability for the activities included in your itinerary, consulting your physician where appropriate.
While on safari, your guide holds an authoritative role in matters of safety and must be followed at all times, particularly with respect to wildlife encounters, walking safaris, and any activity involving an element of physical risk. You are expected to behave responsibly and with consideration for fellow travellers, guides, camp staff, and the communities and wildlife you encounter. Trevaron reserves the right to remove any traveller from a safari, without refund, where their conduct is found to pose a danger to themselves, to others, or to wildlife, or where it constitutes illegal or seriously inappropriate behaviour.
11.Liability
Trevaron Tours and Safaris acts to design, coordinate, and book your safari, working with a carefully selected network of camps, lodges, airlines, and other suppliers. While we take great care in selecting our suppliers, the services they provide (accommodation, internal flights, activities, and similar) are ultimately delivered by those third parties and are subject to their own terms and conditions.
Trevaron’s liability is limited to the proper performance of our own obligations in arranging your safari. We are not liable for the acts, omissions, negligence, or default of any third-party supplier, except where Kenyan or applicable law does not permit such a limitation.
Nothing in these Terms is intended to exclude or limit liability for death or personal injury caused by our proven negligence, or any other liability that cannot lawfully be excluded or limited.
12.Complaints
If any aspect of your safari does not meet your expectations, please raise it with your guide or our team as soon as possible while on safari, so that we have the best opportunity to resolve it during your trip. If you remain unsatisfied after your return, please submit a written complaint to us within 28 days of the end of your safari, and we will respond and investigate in good faith.
13.Governing Law
These Terms are governed by the laws of Kenya. Any dispute arising from these Terms or from your booking with Trevaron will be subject to the exclusive jurisdiction of the courts of Kenya, except where applicable consumer protection law in your country of residence provides otherwise.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be severed, and the remaining provisions will continue in full force and effect.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our operations or applicable law. The Terms in effect at the time you make your booking will apply to that booking.
